Objectives

According to the scope of the Master Course in Internet Engineering, the aim of the course “computer science and new technologies: legal aspects” is that of equipping the student expertise in order to the main legal institutions that underwent the influence of progress in legal computer science.


* Knowledge and Understanding:
the student will become aware of the existence of legal issues connected with information and communication technologies.

* Applying knowledge and Understanding: the student will be able to develop and use such technologies in a law-abiding manner.

* Making judgements:
the student will be able to autonomously evaluate projects by also understanding the related legal aspects.

* Communication skills:
the student will be able to interact with lawyers and legal experts in a qualified way.

* learning skills:
the student will be able to find from qualified sources and to interpret independently the current legislation applicable to its field of interest.

Prerequisites

There are no necessary prerequisites in terms of specialist knowledge.

Contents

The course will cover in particular the following themes:
MODULE I - intellectual property and digital technologies: The legal framework on copyright in the Italian legal system. Proprietary and Open Source software. The concept of contract. Legal requirements of the contract. Transfer of the economic rights on software. Software licenses, open source licenses. Software development contracts.

MODULE II - ecommerce and digital signature: Types of electronic commerce. Information Society Services. Obligations and responsibilities of on-line service providers. Liability of intermediaries (mere conduit, caching, hosting). Contracts made with electronic means. The protection of consumers on-line. Electronic signatures: types and legal discipline. The electronic document: definition, validity and legal relevance, admissibility as evidence before court. The legal validity of e-mails, web pages, electronic registers. The certification of digital signatures. Certified e-mail (PEC).

MODULE III - Privacy and personal data: The legal concepts of privacy and confidentiality. The processing of personal data in the Information Society: general principles. Information obligation and consent. Rights of the data subject. Sensitive Data. Minimum and adequate security measures. User profiling on the Internet. Sanctions.

Module IV - protection of "domain names": changes in legislation and case law; analysis of regulation and assignment of the regulations for the resolution of disputes; legal nature of the domain name and tidying of the discipline following the introduction of the "code of industrial property".

MODULE V - Computer Crimes: Basic elements of criminal law: concepts of crime, fault and intentional wrongdoing, the principle of strict application. Illicit access to an IT system. Detention and diffusion of codes of access to IT systems. Damaging or interruption of an IT or distance-communication system. Illicit interference in electronic communications. IT fraud. Guided analysis of court decisions.

Teaching Methods

Lectures; the course aims to promote a joint work with students. The method of teaching followed alongside the ' theoretical with practical cases and judgments, to enable students to develop a capacity for immediate application of computing to concrete situations.

Attendance Rule: the attendance is not mandatory, but strongly reccomended for coping with the goals and the objectives of the course. Attending the lectures the student may acquire rapidaly the technical terminology, the fundationals, the basis, and so to make progresses in the autonomous study methodology.

The students that not are able to attend the course should in any case download all the material, including slides, that the teacher provides during the lectures (see the website https://elearning.unica.it/) and in any case please contact the teachers for any problem that you may have.

Teaching will be provided simultaneously both in the presence and online, thus outlining a mixed teaching that can be enjoyed in university classrooms but at the same time also at a distance. Each student, at the beginning of the semester can opt, with binding choice, for teaching in presence or at a distance. Depending on the availability of the classrooms and the number of students who will opt for the mode in attendance, a shift may be provided for actual access to the classroom.

Verification of learning

The final exam is oral and includes a question for each of the 5 modules. For each question a score of 0 to 6 will be awarded. The scores obtained on each question will be added to determine the final evaluation.

More Information

Self-assessment tests: the learning will be tested constantly through discussion and debate. During the lessons the teacher gives to the students self-assessment tests to help in perfecting the method of preparation of the exam. The tests will be carried out individually or in small groups, with the support of texts and notes and the answers will be analyzed together with the class. Such tests do not provide for evaluation.
